THE Professional Regulation Commission (PRC) and the Professional Regulatory Board of Real Estate Service (PRB-RES) will have their hands full when the accreditation of real estate salespersons under the Real Estate Service Act (RESA) will start sometime April 2011. That is because an expected 400,000 real estate agents and salespersons who are currently in practice will have to apply for legitimacy of their practice under the new real estate law by virtue of Republic Act 9646.
Under the Implementing Rules and Regulations (IRR) of Republic Act No. 9646 (known as RESA), real estate service practitioners include "Real estate salespersons." A real estate salesperson is referred to as: "a duly accredited natural person who performs service for, and in behalf of a real estate broker who is registered and licensed by the Professional Regulatory Board of Real Estate Service for or in expectation of a share in the commission, professional fee, compensation or other valuable consideration.
The illegitimate, illegal and "colorum" practice in real estate brokerage is one of the pressing issues that must be addressed the soon. It competes with the legitimate real estate service practice, at the same time deprives the government of the needed revenue that must be derived from legal real estate transactions. Immediate licensing of real estate salespersons is one of the right steps to be started with.
